Article 1 APPLICABILITY
1.1 The Consumer Code (Legislative Decree No. 206/2005), the rules on electronic commerce (Legislative Decree No. 70/2003) and, residually, the articles of the Civil Code regulate these Conditions General Sales which apply exclusively to distance selling via the web of the Products offered for sale on the website www.poderetorricella.net
In case of changes in the General Conditions of Sale, the General Conditions of Sale published on the website www.poderetorricella.net will apply at the time the Order is sent by the Customer.
Article 2 ORDERS, CONCLUSION OF THE CONTRACT AND PROCESSING OF THE ORDER
2.1 Customers / Consumers have the right to make purchases on www.poderetorricella.net, as defined by art. 3, co. 1, lett. a) of the Consumer Code, meaning natural persons who make purchases for purposes not related to any commercial, artisanal, entrepreneurial, professional activity carried out, both Customers / Professionals as defined by art. 3, co. 1, lett. c) of the Consumer Code. The invoice request with VAT number always qualifies the customer as a Client / Professional.
2.2 Purchase orders must be placed online through the Order Procedure on the website www.poderetorricella.net. In order to access the Order procedure, the Customer will register online via the page www.poderetorricella.net by “clicking” (after careful reading) of the Privacy information, by entering his / her email address (which he guarantees to be able to legitimately dispose of) and the data requested in the registration form.
The Customer may at any time access his / her profile to update or modify the data entered. The Customer is responsible for the truthfulness and updating of the information provided. Once registered, the Customer has the possibility to select the Products to be purchased from those available on the site.
The Products thus selected will be placed by the Customer in the Cart.
To complete the Order, the Customer must fill in all the fields of the “Web Order Form” form in electronic format regarding the address and method of delivery, payment method, approval by “click” (after careful reading) of the Privacy information and these General Conditions of Sale that the Customer can print and / or store on a durable medium. Before definitively confirming the Order, the Customer must verify the correctness of the Products selected and inserted in the Cart as per the Order summary that will be transmitted by the Customer, electronically, to the Il Turco Company through the interface on the website www .poderetorricella.net by clicking on the “Order Confirmation” button.
2.3 The Azienda Agricola Il Turco will send the Customer, via email to the email address indicated, the confirmation of receipt of the Order containing the summary information relating to the Products ordered, the indication of the price, the means of payment used, costs shipping and any additional costs.
2.4 The contract is concluded when the Il Turco Company sends the Customer the confirmation of receipt of the Order.
2.5 The farm Il Turco has the right to carry out checks on the regularity and correctness of the Order sent by the Customer in order to ascertain any illegal conduct (also regarding the Customer’s majority age), fraud in the use of credit, abnormal purchases or any other fraudulent activity. In particular, pursuant to art. 1456 cc, Il Turco di Castellani C. has the right to terminate the contract (with return to the Customer of the total amount already paid) if: a) The security systems of the IL TURCO company qualify the order sent by the Customer as anomalous o fraudulent in relation to the type and / or quantity of products purchased or the frequency of purchases made on the site; b) The credit / debit cards used for payment are cloned / counterfeited / stolen or there is a reasonable doubt that the purchase was not made by the owner of the same; c) The Customer is a minor or the billing information provided by the Customer is incorrect or unverifiable.
2.6 In case of payment by credit / debit card, bank transfer, the Order will be processed only after the confirmation of the credit of the total amount due by way of price and shipping costs.
2.7 The fulfillment of the Order is subject to the actual availability of the Products: it is possible that between the sending of the Order and the confirmation of the Order by the company Il TURCO, one or more Products ordered are temporarily unavailable. The Il Turco farm will promptly notify the Customer of the unavailability who, at his choice, may: – Wait for the availability of the Products (not available) up to a maximum term of 15 days from the date of the Order, notifying the company THE TURKISH; or – Request cancellation of the Order with reimbursement of the sum already paid (excluding any other compensation or compensation paid by the company IL TURCO) which will be credited with the amount credited through the STRIPE control panel, as will be communicated by the Customer, within the maximum period of 14 days from the request for cancellation (withdrawal). Article 3 PRICES AND PAYMENTS
3.1 Prices are expressed in Euros and are inclusive of VAT. The company IL TURCO has the right to change the Prices without notice: it is understood that the Price charged to the Customer will be the one published on the website www.poderetorricella.net at the time the Order is sent, as shown on the summary screen of the Order confirmation. . The amount and shipping rates are indicated on the Website.
3.2 The Il Turco farm retains full ownership of the Products until full payment of the Price and any expenses has been made.
3.3 The payment methods made available to the Customer are indicated on the website www.poderetorricella.net. Payment methods other than those available at the time of completing the web order form are not accepted.
3.4 If the Customer opts for the payment method by credit card, he will be redirected to an external page belonging to the STRIPE site where the Customer can access through the login systems managed exclusively by STRIPE. The data entered on STRIPE will be processed directly by the same company and will not be transmitted or shared with the Il Turco agricultural company which declines any responsibility for improper use of this payment method. In case of cancellation of the Order and in all cases of reimbursement, for any reason, the amount paid to the Il Turco farm will be credited to the Customer’s account via STRIPE. Once the accreditation order has been arranged, Azienda Agricola Il Turco will not be responsible for any delays or omissions in the crediting of the refunded amount related to the management of the STRIPE platform
3.5 In the case of a bank transfer, the Order will be processed within 3 days of the price and expenses being credited to the bank account in the name of Azienda Agricola Il Turco at the Iban coordinates indicated on the website www.poderetorricella.net.
Article 4 SHIPPING AND DELIVERY
4.1 Deliveries will be made by courier from Monday to Friday, during normal office hours, excluding national holidays. Delivery will take place within a maximum of 30 days from the confirmed Order and payment, if not contextual to the Order. The rights of the Customer / Consumer provided for by art. 61 of the Consumer Code.
4.2 The Azienda Agricola Il Turco will make, where possible, a single delivery for all the Products referred to in the Order, in the case of multiple products ordered. The farm Il Turco reserves the right to carry out – within the maximum term of 30 days from the confirmed Order – staggered deliveries where some Products are temporarily unavailable. In this case, Azienda Agricola Il Turco will inform the Customer via email. No additional delivery costs will be charged.
4.3 Delivery is considered to have taken place when the Products are made available to the Customer at the address specified in the Order form.
4.4 Upon delivery, the Customer will check that each package and packaging containing the Products is intact, not damaged or wet and that the number of packages corresponds to that indicated in the delivery document in the hands of the shipper. Any disputes must be reported immediately and must be reported in writing on the delivery document and countersigned by the shipper. If, upon delivery, the Customer finds obvious damage to the packaging, he will accept the parcel with reserve by signing the document delivered by the driver in the appropriate box dedicated to acceptance with reserve. Azienda Agricola Il Turco cannot be held responsible for damage to the Products if the damage to the packaging or delivery package has not been promptly reported to the shipper.
Article 5 RIGHT OF WITHDRAWAL and LEGAL GUARANTEE IN CASE OF CUSTOMER / CONSUMER
5.1 The right of withdrawal is excluded pursuant to art. 59 of the Consumer Code, for purchases of Products that risk deteriorating or expiring rapidly and for sealed Products that cannot be returned for hygienic reasons or related to health protection or that have been opened after delivery.

5.3 The Customer / Consumer, subject to the exclusions specified above, has the right to withdraw from the contract without any penalty and without specifying the reason pursuant to and for the purposes of Articles 52 and following of the Consumer Code. The Customer / Consumer exercises the right of withdrawal by sending the withdrawal form or a written communication in which the Customer / Consumer explicitly declares the will to withdraw, within fourteen days from the moment in which the Customer / Consumer (or a third party designated by Customer / Consumer) acquires physical possession of the Products in relation to which the Customer / Consumer intends to exercise the withdrawal.
The withdrawal form or the communication are sent by e-mail to info@poderetorricella.net or by registered letter with acknowledgment of receipt addressed to FATTORIA IL TURCO, VIA S. Vincenzo, 43, 50025 Montespertoli – FI.
The withdrawal communicated by e-mail must in any case be confirmed by the Customer / Consumer by registered letter with acknowledgment of receipt sent within the following 48 hours. Within the non-extendable period of 14 days from the day on which he communicated the withdrawal, the Customer / Consumer must return the Products at his expense, in undamaged and undamaged packaging, to FATTORIA IL TURCO Via S. Vincenzo, 43, 50025 Montespertoli FI. Cash on delivery packages will not be accepted. The Customer / Consumer will only have to bear the direct costs of returning the Products to the Il Turco farm. IL TURCO will, as soon as possible, and in any case within 14 days from the day on which it is informed of the Customer / Consumer decision to withdraw from the contract pursuant to Article 54 of the Consumer Code, to credit the Customer / Consumer all payments received by the same, possibly including delivery costs (with the exception of additional costs deriving from the Customer / Consumer choice of a type of delivery other than the less expensive standard delivery type offered by IL TURCO). These refunds will be made using the same payment method used by the Customer / Consumer for the commercial transaction, unless the Customer / Consumer has agreed otherwise. In any case, the Customer / Consumer will not have to incur any costs as a result of this reimbursement. The refund may be suspended until the COMPANY IL TURCO has received the Products or until the Customer / Consumer demonstrates that he has returned the Products, whichever is earlier.
5.4 The Customer / Consumer benefits from the legal guarantee for the lack of conformity of the Products referred to in articles 128-135 of the Consumer Code.
To use the warranty, the Customer / Consumer must keep the invoice that he will receive from IL TURCO COMPANY. The legal guarantee in favor of the Customer / Consumer covers any lack of conformity existing at the time of delivery of the Products that occurred within two years of delivery of the Product itself, provided that it is not a Product which by its nature is perishable or subject to expiration in a shorter term, in which case the guarantee will operate within this reduced term. The lack of conformity must be communicated by the Customer / Consumer to IL TURCO by registered letter sent to Azienda Agricola Il Turco Via S. Vincenzo, 43, 50025 Montespertoli FI, under penalty of forfeiture, within 60 days from the date on which the Customer / Consumer has discovered the defect, provided that it is not a Product which by its nature is perishable or subject to expiration in a shorter period, in which case the defect must be reported within this shortened period. The action against the company IL TURCO is prescribed in any case within the term of twenty-six months from the delivery of the Product. In case of lack of conformity, the Customer / Consumer has the right to replace the Product according to the provisions of art. 130 of the Consumer Code. Upon receipt of the communication, IL TURCO will contact the Customer / Consumer to communicate the methods of returning the Product. IL TURCO will send its own courier to collect the product at no additional cost for the Customer / Consumer. The Products considered defective by the Customer / Consumer must be returned “almost full”, tightly closed, so that there are no losses during transport, and with the original caps and / or wrappers and possibly in the original packaging, complete in all its set off. Empty or half-empty packages will not be refunded or replaced.
Once the Product returned by the Customer / Consumer has been checked, IL TURCO will replace and ship the product itself, except for the provisions of art. 130 of the Consumer Code. If following the verifications carried out IL TURCO the alleged lack of conformity is not identified pursuant to articles 128 and following of the Consumer Code, the Customer / Consumer will be charged for any verification costs, as well as transport costs, if incurred by the company IL TURCO.
5.5 If the purchase is made by a Customer / Professional, in the event of flaws and defects, only the legal guarantees referred to in Articles 1490 and following of the Italian Civil Code will apply.
Article 6 APPLICABLE LAW AND JURISDICTION
6.1 Italian law is applicable to these General Conditions of Sale and to the purchase and sale contracts regulated by them; International conventions or other agreements or private international law relating to the law applicable to the sale of goods and / or services are excluded.
6.2 Any dispute that may arise regarding these General Conditions of sale and purchase and sale contracts regulated by them, will be devolved to the exclusive jurisdiction of the Court of FLORENCE, without prejudice to the mandatory rules provided for by the Consumer Code in the presence of Customer / Consumer in which case jurisdiction mandatory will be that of residence of the Customer / Consumer.
6.3 DUTIES AND TAXES Before shipping, you will have the option to prepay any duties and taxes or to proceed without paying upfront.
